EDEN, N.C. - Limiting pharmaceutical companies' liability for the drugs they manufacture is a tough pill to swallow for Andy Ayers of Eden. That's why he's writing to state legislators, speaking out against House Bill 542.

Ayers lost his wife in 1994 to a massive heart attack after doctors prescribed a commonly used drug to her after she had their first and only child. Eight days after becoming a father, Ayers became a single father.

"I don't think I ever got over any of the experience that went on during that time, as soon as my wife died. That's going to stay with me for the rest of my life."

The bill before the state House would prevent consumers from suing drug companies unless the company obtained federal Food and Drug Administration approval by fraud or bribery.

Ayers is now one of many asking the Legislature to vote down the bill. He says liability is one tool patients have to ensure that pharmaceutical companies maintain the highest standards for patient safety.

"It's unfair to the ones that are being prescribed the drugs. Somebody has got to be liable for what happens - side effects and everything - and it shouldn't be just the doctors."

Proponents of HB 542 argue that tort reform is necessary to cut down on medical malpractice cases in the courtroom and rising medical costs. If passed, North Carolina would be the second state in the nation to offer immunity for pharmaceutical companies.
