Clean Power Plan, Court Ruling Have Some in TN Breathing Easier

KNOXVILLE, Tenn. - The Environmental Protection Agency's Clean Power Plan is making headlines this week, but clean-energy advocates say it isn't the only news event related to a greener way of producing power.

A U.S. Circuit Court of Appeals has upheld the Cross-State Air Pollution Rule, which reduces emissions from coal-fired power plants in 28 eastern states including Tennessee, to cut down on pollution migrating across state borders.

Angela Garrone, Southeast energy research attorney with the Southern Alliance for Clean Energy, said Tennessee should see big long-term benefits as neighboring states are forced to clean up their air.

"Tennessee does have that issue," she said, "especially in east Tennessee, with air pollution coming down from Ohio and other northern states that have a significant amount of coal plants."

The EPA's Clean Power Plan calls for a 32 percent reduction in greenhouse gases from power plants by 2030 and requires each state to submit a plan to meet those goals. Opponents of the Clean Power Plan argue it will lead to increased electric rates for consumers and businesses.

Garrone said enacting the EPA's plan in Tennessee should be easier than in some other states, since there is only one energy provider, the Tennessee Valley Authority. With TVA's plans to retire several coal plants across Tennessee, Alabama, and Kentucky, she said, the Clean Power Plan should enable the state to continue its momentum.

"Tennessee, it's important because we historically have had problems with air pollution in this state," she said, "both impacting public health as well as haze problems in the Smoky Mountains."

Once the Clean Power Plan is officially approved by the EPA, states will have until 2022 to implement the rules, although it's expected the plan will be challenged in court and in Congress.
