A Battle for the Soul of WA Supreme Court?

OLYMPIA, Wash. - One of the hottest races on the Washington primary ballot is the reelection battle of state Supreme Court Justice Jim Johnson. He's being painted by progressive groups as an ultra-conservative, who sides with corporate interests and is an outspoken opponent of same-sex marriage, and yet, he has received endorsements from newspapers around the state for his positions on free speech and open government.

Attorney and state legislator Brendan Williams (D-Dist. 22) was a law clerk for the state Supreme Court. He says Johnson's beliefs have made for six eventful years on the bench.

"Johnson has been most ardent in his judicial activism, to the degree where he's been reprimanded in dissenting or majority opinions by his colleagues, and even had one of his rulings expressly overturned by the Legislature."

Challenger Stan Rumbaugh is a Tacoma attorney with endorsements that include Fuse Washington, Planned Parenthood, and the Washington Conservation Voters. Williams says the outcome of this race is more than just 'conservative versus liberal.'

"I think it's really a battle for the soul and the future of the Washington Supreme Court. The court is very often divided five-to-four on decisions, so the decision as to whether or not to retain Justice Jim Johnson is pretty pivotal when it comes to the future of justice in the state of Washington."

The primary vote is critical in Washington Supreme Court races. If a judicial candidate receives more than 50 percent of the primary vote, that person goes on to the general election ballot alone, virtually assuring their win.

Two other justices, Richard Sanders and Chief Justice Barbara Madsen, also are up for reelection. Madsen is running unopposed. Ballots are due Tuesday, August 17.
