Loan Modification Scams: Tips for Virginians

RICHMOND, Va. - Loan modification scams in Virginia, how they are conducted, the companies and people behind them, and the number of people being scammed are the topics of a new report that chronicles a year-long undercover investigation into the practice. The scammers target struggling homeowners with claims they can "guarantee a loan modification" and "stop foreclosures" - all for a fee - and often the homeowners end up losing the fee, as well as their homes.

Amy Nelson is director of investigations and enforcement with Housing Opportunities Made Equal (HOME) in Richmond, one of the agencies responsible for the report. She says the number of companies using questionable tactics was striking.

"We were shocked at the numbers that encouraged homeowners to not make their mortgage payments and the number we found that encouraged the homeowner to put forth fraudulent information."

Nelson says 292 complaints were lodged by Virginians who reported being scammed to the HOME website. HOME is working with state and federal agencies on possible legal action against several companies.

The majority of companies offering services in Virginia were based in California or Florida, she says. As part of the investigation, Nelson interacted with many of the agents from those companies.

"There's a whole other piece as to how they are on the phone with individuals, really acting like they're the only ones that this homeowner can count on and they should be trusted. All the while, I could recognize the signs that what they were pitching was not in fact, lawful."

Nelson advises homeowners to avoid companies that require an advanced fee, guarantee to stop foreclosure or get your loan modified, or advises you to make a mortgage payment directly to them. She says to report any scams to the Virginia Attorney General's office, to HOME, or to the group's website, www.loanscamalert.org.
