Sindicatos, grupos ecologistas y otras organizaciones progresistas están liderando la reforma del proceso de referéndum de California, que permite a los votantes derogar leyes aprobadas por la legislatura.

El proyecto de ley 421 de la Asamblea surgió después de que la industria petrolera reuniera firmas para derogar una ley que impide nuevas perforaciones en los vecindarios.

El asambleísta Isaac Bryan, quien presentó el proyecto de ley, dice que el sistema actual incentiva a los recolectores de firmas a engañar a los votantes.

"Las compañías petroleras gastaron casi $ 25 millones en 90 días para reunir las firmas para detener la ley y poder solicitar nuevos permisos de perforación, y ponerlo en el referéndum", dice Bryan. "Hubo horas de evidencia documentada en video de que muchos de los recolectores de firmas simplemente estaban mintiendo a la gente."

En la actualidad, es legal redactar un referéndum de forma confusa, de modo que un "sí" anularía la ley en cuestión. Según el proyecto de ley propuesto, los votantes simplemente decidirían si mantienen o derogan la ley. La Cámara de Comercio de California se opone a la ley A-B 421, argumentando que encarecería la recolección de firmas y debería requerir una enmienda constitucional.

Bryan dice que el proyecto de ley también obligaría a los encargados de recoger firmas a llevar una tarjeta de identificación con su nombre, número de identificación y foto.

"La gente debería tener la formación adecuada y estar registrada también," opina Bryan, "para que quede claro que, si están violando la ética de la recolección de firmas, se pueda denunciar de forma responsable."

El proyecto de ley exige que las peticiones identifiquen a los tres principales donantes del referéndum y exige que al menos el diez por ciento de los recolectores de firmas sean voluntarios de la comunidad. El proyecto de ley ya ha sido aprobado por la Asamblea del Estado. La siguiente etapa es el Comité Electoral del Senado.
