Esta semana, cuatro grupos de defensa han presentado un informe amicus curiae en un caso ante la Corte Suprema de California que involucra acusaciones de abuso de personas de la tercera edad y el uso de arbitraje.

Un centro de enfermería especializado, Country Oaks en Pomona, está tratando de forzar el arbitraje en un caso en el que el paciente, Charles Logan, le dio a su sobrino el poder de firmar documentos de atención médica, pero no le dio poder notarial, y luego Logan demandó a Country Oaks, alegando negligencia. Un tribunal de apelaciones decidió que el sobrino no tenía capacidad legal para firmar el acuerdo de mediación como parte de los formularios de admisión.

La abogada Jessica Pezley, del grupo de defensa Compassion & Choices, sostiene que la Corte Suprema de California debería confirmar esa decisión anterior.

"La ley de decisiones sanitarias solo se refiere a las decisiones sanitarias. No se refiere a decisiones que afecten futuros derechos legales. Y así, cuando alguien firma una directiva anticipada, en ninguna parte de su mente está pensando que podría estar renunciando a su derecho constitucional a un juicio con jurado," indicó la entrevistada.

Country Oaks argumenta que el acuerdo de mediación debería permanecer en vigor. El Sr. Logan ya falleció. La política federal de los Centros de Servicios de Medicare y Medicaid establece que los acuerdos de mediación son estrictamente opcionales y no pueden ser necesarios para la admisión a un centro.

Pezley dice que la mediación corporativa a menudo se inclina a favor del acusado.

"Al obligar a arbitrar, Logan no habría tenido su derecho constitucional a tener un juicio con jurado. En cambio, iría frente a un árbitro, lo que tiende a estar a favor de las corporaciones, solo porque las corporaciones son las que tienden a usar el arbitraje de manera repetida," analizó también Pezley.

El patrimonio de Logan ahora está en el centro de atención del caso. La Corte Suprema de California aún no ha anunciado una fecha de audiencia.
